Nelson's Drug Law Thrown Out
One of Nelson Rockefeller's last achievements as the Governor of New York has been ruled unconstitutional by a Rochester court.
A Monroe County Court has struck down the mandatory life sentence provision of New York's controversial new drug law.
That drug statute requires the imposition of life sentences for the sellers of such drugs as heroin, cocaine, and even hashish. Judge Andrew Celly said that the mandatory life sentence "offends the conscience of the court and, beyond reasonable doubt, the principles inherent in the Constitution."
